La custodia compartida sobre los hijos no ha de ser «una medida excepcional sino, al contrario, habrá de considerarse normal e incluso deseable, porque permite que sea efectivo el derecho que los hijos tienen a relacionarse con ambos progenitores, aun en situaciones de crisis, siempre que ello sea posible». Así lo establecía el Tribunal Supremo en una sentencia de 29 de abril de 2013. Pues bien, de acuerdo a los datos estadísticos más recientes, hoy podemos decir que, efectivamente, la custodia compartida sobre los hijos ha dejado de ser una excepción.
Aquella jurisprudencia ha tardado en germinar en nuestra sociedad, pero las estadísticas muestran que, indudablemente, ya lo está haciendo: la custodia compartida sobre los hijos está dejando de ser una excepción para convertirse en la situación establecida para una de cada cuatro separaciones con hijos menores.
Según datos del Instituto Nacional de Estadística, en el 24,7% de los procesos de divorcio habidos en España en 2015 se concedió la custodia compartida de los hijos menores. El año anterior la custodia compartida sobre los hijos se había adoptado en el 21% de los casos y, en 2007, únicamente para el 9,7%.
La sentencia arriba aludida vino a desarrollar la reforma de nuestro Código Civil que recogía la posibilidad de este régimen (Ley 15/2005, de 8 de julio:

El legislador señaló en 2005 que «se acordará el ejercicio compartido de la guarda y custodia de los hijos cuando así lo soliciten los padres en la propuesta de convenio regulador o cuando ambos lleguen a este acuerdo en el transcurso del procedimiento».
Como vemos, la doctrina del Supremo ha ido más allá y la realidad jurisprudencial también. Esta distancia entre la norma y la jurisprudencia ha querido ser cubierta por diferentes leyes autonómicas, algunas de las cuales ha anulado el Tribunal Constitucional porque invadían competencias del Estado.
En cualquier caso, la doctrina del Supremo sigue estableciendo una y otra vez que la custodia compartida sobre los hijos es el sistema, a priori, deseable. Así, por ejemplo, en sentencia de 29 de marzo de 2016 reprochó a la Audiencia de Madrid que no hubiera tenido en cuenta su doctrina al respecto:
«La sentencia, ciertamente, desconoce, como si no existiera, la doctrina de esta Sala y pone en evidente riesgo la seguridad jurídica de un sistema necesitado de una solución homogénea por parte de los Tribunales a los asuntos similares”.
En esa sentencia el Supremo llega a reprochar a la Audiencia de Madrid su «desconocimiento de la jurisprudencia y un escaso o nulo esfuerzo en incardinar los hechos que se ofrecen por ambas partes en alguno de los criterios reiteradamente expuestos por esta Sala sobre la guarda y custodia compartida”.
Un elemento central de la jurisprudencia del alto tribunal radica en la necesidad de un cierto clima de acuerdo entre los padres. En una sentencia de diciembre de 2014 el Supremo descartó conceder la custodia compartida a un progenitor que había sido condenado por delito de amenazas a su ex mujer:
“Constituye una premisa necesaria para acordar el régimen de guarda y custodia compartida que entre los padres exista una relación de mutuo respeto”.
Aún así, en otros casos el alto tribunal ha matizado que las lógicas divergencias propias de la ruptura matrimonial no deben ser por sí solas motivo suficiente como para negar la custodia compartida sobre los hijos si ésta va a actuar en beneficio del mayor bien jurídico a proteger, el bienestar del menor.
